Yes, in order for the person whose name was forged to prevail in a suit the person who committed the act must be held responsible. If the issue is something such as a credit card debt a fraudulent act to obtain goods or services has been committed. Credit card fraud or stealing by deceit can result in civil and criminal penalties if the person is found guilty of the charge(s).
