Chances are more than likely that someone in death row is/was innocent and will be/was executed. With advances in forensic sciences such as DNA evidence, many incarcerated people have been exonerated for being wrongfully accused, some have even been in jail for decades before being exonerated.

Less than one percent. Over the past century about 25 people have been executed in the US and then later proven innocent. Now we have DNA testing which takes away almost all doubt of innocence or guilt. And there also must be a unanamous vote for the death penalty. So now there is almost no way to be executed and then proven innocent.

I think it has to be proven, but you can be in jail while you are in court and you're technically innocent until proven otherwise (America).
