that depends on a couple of things
first of all what type of crash did you have , were you involved with another vehicle , a person and animal etc.
secondly how did you determine that the "unkept road " was the cause and what was the unkept condition that caused the accident in your opinion.
Basically you cant blame the road condition for an accident unless you can show that the unkept nature was either the contributinig factor to the accident and that is was a condition which was in place for a reasonably long period of time where the owner of the road knew it was defective and failed to repair it or adequately notified drivers (for example put up a sign or flasher etc to warn of the hazard) The idea is that you should be aware of the road condition and have your vehicle under control to avoid such hazards - good luck
