The age of consent varies by state (and country to country). Even if the girl says she consented to have sex with him, if she was below the age of consent, it is statutory rape. Anyone can report him and the state press charges. If either the man or the girl admit that they had sex before she reached the age of consent (or the pregnancy proves it) the man can be convicted of statutory rape. The fact that the girl testifies that she doesn't want him to go to jail or that it is consensual is irrelevant. Her age renders her unable to legally consent with an adult man. If she is above the age of consent, she may consent to sex without it being rape.
