NO she can't take the baby by law and raise it herself. There is welfare out there you know for mistakes like this. I didn't say it would be easy though, but you can do it and it is possible. Afterall, I did it 19 years ago when I was 16 and he was 20. Yeah I got on the welfare thing and my situation was a little different than yours. He and I were together. If you are not with the guy, you still can do it though and you may think.......well they have money and I would just have government support. Well that's what my taxes pay for, for emergencies that come from accidents. Now, I'm 36 and have not been on welfare since my daughter was 5. I make over $40,000 a year and am a single mom of 3. * Minors have the same legal right to their child as does an adult. The law presumes that an unmarried female has full custodial rights to the child until the court rules otherwise. The financial status of the minor female is irrelevant. If the adult father has not established parentage that will have to be done before the court will address issues relating to the child (custody, visitation, child support, etc.). The adult male should be informed that the AOC for the State of California is 18. That being the case he can be subject to criminal charges and prosecution including that of statutory rape even if the sex was consensual.
He would have to complete the legalization process. Once the process is completed, he could file for custody of his child.
