Well, I'm 16 and when my parents got divorced it said that when I told 13 or 14 I was old enough to decide which parent I wanted to live with. I left my father's house to live with my mom, she now has custody of me and I can go visit him if I choose to. I think it might be the same for you as well. You'd have to check into you're parents divorce thingy or ask your family lawyer. But, I don't think he can legally say you can't live with your mom unless he has full custody.
