Your governing documents provide for a dissolution of the association, which is a process normally followed after a disaster that renders the community unusable for its intended purpose.
Otherwise, without an association, how do the remaining occupants manage:
- Insurance
- Maintenance
- Replacement of key common elements
Simply declaring that a condominium association is no longer an association isn't really a workable situation under the law. However, you may be able to find an association-savvy attorney who can help you carve up the real estate assets and figure out a way to sell them to people interested in buying such a real estate asset. Or not.
