Can a credit card company take you to court if you have a balance of 7800 dollars or more?

Answer

I really dislike being the bearer of bad news. But, yes they can sue you for any amount large or small. Small cases usually less than $3,000 go to Small Claims Court. All others depending on laws of your state, are heard in Circuit Court. Most of us know that credit cards are usually unsecured debt(s). Which often gives people, the false assumption that CC companies have no recourse if a card holder defaults. They can sue, and will probably win a judgment against the creditor. Not being able to pay is not a defense, even though that makes little sense. Getting a judgment and collecting it however is a different matter. Some actions a creditor can take is garnishment of wages and bank account(s). Sometimes the seizure of personal and real property (such as a house). What is important is every debtor has legal exemptions for BK, or lawsuits. These exemptions usually leave the debtor with most if not all of their property. There is a set amount that can be awarded in garnishment proceedings. These are detemined by the laws of the state the debtor resides in. They cannot be any amount that might cause hardhip to the debtor and their family/dependants.
