In the state of AL the custodial parent can leave the state without consent but you must first write a letter stating where you will be going and for what purpose then you must send it certified mail(must be signed for)after 30 days if he has not responded or started legal procedures then you can go and he can't do anything about it.I was told this by my attorney and have been living in a different state for 2 years now with no problem.

Arizona does not allow it without permission of the court, regardless of whether a preexisting custody was in place. Most state require the existence of an order, but either way, the other parent can and should file an injunction to prevent it until access rights are addressed. I teach fathers how to do this.
