Yes. Wrong! The only time some one pays "Back Child support" is if the work and do not pay the correct amount from their pay checks. If a person is unemployed the are not liabel for child support. It is the same as if a mother is not working: she can get welfare and she does not have to pay back the money.

YES!! They do have what is now called Child Support Jail && Court. They can keep you locked up for a certain amount of time. Like paying for a ticket by going to jail for a couple days. Or they also help you find a job so that you can start paying for child support. But they will automatically deduct 10-25% out of every check before you even get it.

Well,

apparently in the wonderful state of Michigan, an offender (a thief convicted more than 3 times for the same felonies while on parole) who is currently serving time has a right (a convicted offender having a right is bs to begin with) to not be obligated to pay cs. They "suspend" the agreement without even running a tab; HOWEVER, if you happen to be a law abiding citizen who, by not fault of his own, was laid off due to the corruption and downturn of the Michigan economy and is now on unemployment, you will still be obligated and turned criminal for said unpaid support and even have driver's licenses and other state or federal licenses suspended.

So, the answer to the above referenced bs question is: No, he/she is apparently more important than the other parent or child being left behind. Stupid how being a criminal somehow relieves you of obligations that others who abide would be jailed for.

Yes - it's civil contempt.

It's just not as common for denial of access.

In my state (GA), if no child support is paid in a 30 day period, the "receiver" can issue an abandonment warrant, which is a criminal case. If you (the "payer") show up in court without any money, you will AUTOMATICALLY go to jail for ONE YEAR PER CHILD.

It's the stupidest law on the books, in my opinion. How does going to jail get the child support paid? Dumb, dumb, dumb.

Incarceration does not automatically terminate or suspend child support. On the other hand, there's likely no income, either.

Possibly. It depends on what the crime committed is. If it is mass murder definitely but something like shop lifting probably not. It just depends on what you committed.

What if the father is not paying child support and is a convicted felon with a criminal history does he still have visitation rights?

Visitation rights and child support are 2 separate issues in court. They see to what is best for the child and it often is to see both parents. It also depends on why he is not paying child support. If there is such order and he is not paying there are ways the court can see to that he does but you need to let them know he is not paying. You can not deny him visitation on your own, that would be breaking the court order and will get you into legal trouble. It's up to the court to decide if he is unfit for visitation based on his criminal past. Just because you've been to jail in the past does not mean you are a unfit parent now.

When is a father put in jail for not paying child support?

It depends on the court and the persistence of the custodial parent. The custodial parents who are the most aggressive about pushing the court to enforce child support orders get the most results. Jail time results when the obligor refuses to payand not if they are trying to pay and have arrears. The legal basis for incarceration for non-payment of child support is contempt of a court order. The non-paying obligor can also be denied a passport and any type of license if they fall behind or refuse to pay child support payments. An arrest warrant for child support follows the defendant everywhere in the United States pursuant to the Uniform Reciprocal Enforcement and Support Act. Tracking utilizes the social security number.

If you are pregnant with a 16-year-old illegal Mexican's child can you file for child support when the baby is born without him being deported and does he have to pay?

If he is illegal, then you have no foot to stand on. He will likely be deported if any state authority finds out he is illegal. If he becomes legal, then he must pay. If not, then he doesn't have to do anything for you.not true, illegal or not he is the father and will have to pay child support. my husband has a child from a previous marriage and we pay child support, but a few years ago before we were married he left and returned to Mexico for a few months. his ex filled for child support through the state and received it, and we are paying that back to the state as well. you need to talk to him about paying you, and if he refuses, then contact your state child support office and tell them you situation.AnswerDepending on your age you could end up in jail youself for statutory rape. It's hard to get child support for your child from the child you slept with.
