Not technically, if they're under the age of 17 yes it is highly illegal ANYWHERE. So long as the person is 17 it is legal, Title 18, chapter 117, section 2423 and 2422 of the criminal code state; . So long as age of consent is proportional to the ones age your not taking part in a criminal offense so yes it is legal, its just nice to let the parents know.

As long as you are willing to serve time for kidnapping There is usually a stipulation in a good custody order that says things like, "Both Parents agree to give a 48 hour advanced notice should one need to travel out of state" or "No parent will remove child from state of residence without providing written contact documentation for the absent parent." It is hell if you have been in my shoes and have raised children with an absent father for 15 years and are now required to "ask" permission to do something that was recently required of you by law. If I had chose my X-Husband's route and left the state for 15 years without contacting my children, I would have been charged with neglect, the state of CA would be my children's guardian and I would have to fight tooth and nail to reestablish contact with my children. My X husband had to walk into a pro bono Father's Rights lobby and simply state, "I have been in another state strung out on dope for the last 15 years, I have completed a 30 day drug program, and I will agree to take parenting classes if you allow me 50% custody and lower my child support from $100/mnth to $50.00/mnth. The court said "great". His support was lowered, he took my son out to Pizza twice, introduced him to 3 or 4 "daughters" that he required my son to call "sisters" (his rehab girlfriend's children) and I was labeled an atheist in court because I was reluctant to surrender my weekend for a born again and then again- junkie turned sober for a month spiritual retreat! He moved to Mississippi within a month and I got to re-enroll my son in a therapy group for teens who have been abandoned by their fathers. So, if your a dead beat dad and your asking because you want to ditch your responsibilities- do your kid a favor and leave the child alone- If you are the mom without a court order, address a letter to your last known address of absent parent, (hopefully your own household) and state exactly where you are going and for how long, send it to yourself and leave. Once you are where you need to be, get an order stating there is an absent parent.

  • No, grandparents cannot take a child across a state line without permission from the parents mainly because of the 'Amber Alert' laws. It is wise to get a written consent from the parents along with the birth certificates of the grandchildren.
