As they are now divorced , and the child is with her in custody, but she can not take the child out of the country on any reason what so ever , without his consent. That is why it is good to be friends after a divorce.

(in the US) The baby would need a passport to leave the country and a US passport cannot be issued to the baby without the consent of both parents. HOWEVER - if there is any intent contemplated to permanently separate the father from his child, no, that is unlawful. This is especially true if there is some kind of legal action taking place over divorce and/or custody matters.
