Does the Form 8332 (used to release the exemption to the noncustodial parent) affect the Child Tax Credit? Yes. The Child Tax Credit can only be claimed by the parent claiming the exemption. In this case the noncustodial parent would qualify for the dependency exemption and therefore the child tax credit. You may be able to claim a child tax credit if you have a qualifying child. A child is your qualifying child if the child:

  1. Is a citizen, resident, or national of the United States,
  2. Is under age 17 at the end of the calendar year in which your tax year begins,
  3. Is your son, daughter, stepson, stepdaughter, legally adopted child (or a child lawfully placed with you for legal adoption), brother, sister, stepbrother, stepsister, foster child placed with you by an authorized placement agency or by a court order, or a descendant of any such person,
  4. Shares with you the same principal place of abode for more than one-half of the tax year, or is treated as your qualifying child under the special rule for parents who are divorced, separated, or living apart, and
  5. Is not treated as the qualifying child of another taxpayer under the special rule for two or more taxpayers claiming a qualifying child or the special rule for parents who are divorced, separated, or living apart.

There are tax forms which will allow you to claim the child on your taxes with the custodial parents permission. However, if you are in arrears the state will likely seize your tax return and give it to the custodial parent. It should be noted that the parent who can claim is not based on custody, but by time spent with the child.

No, the person who has the child is the person who gets the child support so she would have to pay child support herself, as well as the father, to the person who has custody of the child.
