State laws vary, but if there is a mechanics lien on your car, or your car is impounded by law enforcement because of drug possession, the answer is yes, yes they can.

Typically law enforcement will not impound and auction a car that has a lien on it for the value of, or more than the car is worth. A mechanics lien is different and they can have the car essentially repossessed, if they go through proper legal channels. Generally speaking, in most states, someone can't just come into your driveway, take your car, and then sell it to pay a debt without filing appropriate paperwork with the courts and legal authorities.

Even if you don't have money for an attorney, you can search your state laws online, seek legal aid at a college or free clinic, or do your own research at a college library that teaches law. They'll typically have books on the topics with how laws are handled in your own state.

Can an owner of an apartment complex sell apartments if he has a lien on them?

The lien will have to be paid before the sale can go through. Possibly the amount of the lien could come out of the sale proceeds, but you would have to check with the title company to see if this is legally possible.

What happens if you leave your car with the towing company in CA and you dont want the car back?

Most reputable towing companies will sell or "dispose" of your vehicle through the lien sale process. If any monies are collected from the sale that amount will be deducted from the total amount due on the lien sale date. Your information will then be forwarded to a collections agency and attached to your credit if you fail to pay. This is supported by the CVC (California Vehicle Code) because it is considered abandoning your vehicle. There are some, usually shady and will bite you in the end eventually, companies that will let you sign over the title.

How do you get your lien paid when a homeowner sells his house?

The title company handling escrow and the documents should see the lien, which should be recorded, when they do the title search. When the sale goes through, the amount of the lien will be included in the settlement. If there will not be enough money, the debtor should be required to pay the lien and present a paid receipt for it. Possibly you could do a little research if you are aware of the sale of the house and call the title company to be certain that the lien has been found.

How do you find out if your truck was moved before the lien sale date and kept by tow company. can the lien holder not put it up for auction after notifying vehicle owner of lien sale and date?

What is an auto lien?

An auto lien means that another person has a claim to the auto too. It is not owned outright. Auto liens are usually entered into when an auto purchase is financed through a bank or other creditor. These are mutual agreements made during the sale and the lien is entered in the county recorder's office for the record. If you wanted to sell the auto before fulfilling your loan agreement and having the lien discharged, then the 1st lien holder (usually the bank) has specific rights to any proceeds from the sale before anyone else, including yourself.

What happens if you no longer have the car and the finance company trying to repossess?

Someone has the car and the finance company has a lien on it. Any sale would have been fraudulent.

Can a towing company place a lien on a vehicle and the vehicle owner's driver's license for money owed?

YES in some states, Florida, Washington, California come to mind a vehicle towed at the request of a law enforcement agency can have a lien placed on the vehicle and after the sale of it any and all negative balances due can have a lien placed upon either (depends on the state laws) the vehicle license plates or your drivers license.

Can a towing company auction a vehicle without notice?

only if they have a lien on the the title for any service that you have not paid for. its called a mechanics lien. Even if they have a mechanics lien, they still have to notify the registered owner via certified mail, and give them a chance to pay the bill. You can't just get a title or magistrate's bill of sale without proof that you have done everything possible to contact the owner first. The owner has 30 days to contact the person that has the vehicle. If they don't, then the vehicle can be sold at a magistrates auction and will be given a title for the vehicle.

If I do not have a bill of sale how do I obtain a title for a vehicle that I bought from a towing company that's still in previous owners name and towing company won't transfer the title?

If the towing company sold you a vehicle, they must have a title or a magistrates bill of sale. If they sold you a vehicle without one of these, then they sold you something that wasnt theirs to sell you. You will have to take them to court to get your money back. Call them and let them know what your intentions are and they will probably come up with one or the other instead of going to court.
