Can an employer find out if you have been fired for theft? |
[Edit] |
Answer
I don't think they can find out why you were fired, but I'm sure they can find out that you were fired. If it was your last job, it will be easier for them to find out. If it was a while ago, it will be harder and it won't matter as much anyway, especially if you've had jobs in between that one and the one you are applying for.
Answer
They can not find out if you were fired or why you were fired. By law, the only information they can get from your other employers is the dates you worked there and whether or not they will rehire you.
- Not at all true. Pay, raises you got, dates, job titles, quality of work, etc. There's a lot that they can ask. More than they can't in fact. It's just that most companies won't readily if at all give it.
Answer
If the new employer contacts the old employer, it is illegal for the old employer to give out detailed information as to why you were fired. If he does give out this information, he can be sued by the employee
Answer
They can if you were charged with the theft.
Some places will require you to submit to a background check and if you have a criminal record they'll find out.
Answer
They can find out by doing a simple background check to see if you have ever been charged or have a criminal history. Technically they are not allowed to ask a previous employer why you are no longer with them, and technically your previous employer is not allowed to say why you may have been fired. But many employers will ask anyways if they are not aware of the law, and they may hear about any inappropriate behaviors you engaged in at a previous job by "accident".
