Generally insurance coverage should be offered to an employees spouse. It does not matter if they are offered coverage from their employer whereas it provides an additional option in case 1 plan is more affordable than the other.

Can employer take away your health insurance if you are pregnant and a fulltime employee?

The employer cannot take away your health insurance, unless the plan is dropped for all employees. To take away your health insurance would be a clear violation of the federal and state rules about discrimination against pregnant women. You would have a strong case to take to your state human rights commission. The employer could not legally take away your health insurance, but they could do the next best thing: fire you. The Americans with Disabilities Act (ADA) does not consider pregnancy to be a disability. Therefore employers do not have to make reasonable accomodation for pregnant employees. The result is that a pregnant employee could be legally fired because she needs more bathroom breaks, or cannot do heavy lifting. For many women, being fired from a job means losing their group health insurance. COBRA coverage may be very expensive, especially for someone who is pregnant and probably cannot work full-time for a new employer.

Is your husbands health insurance provider legally allowed to deny his wife coverage if she works part time?

It depends on how their plan document is worded and the specific reason given for denial of coverage for the wife. If their plan document states that dependents with access to other coverage cannot be enrolled and the wife has access to insurance through her employer, then they can.

Can an employer force you to keep insurance on dependent children if your ex has insurance on them but the insurance won't drop coverage unless there is a court order for the ex to cover them?

Your employer can not legally force you to insure anyone unless the employer is in possession of a court order that requires the employer to keep this coverage in place. In going thru this issue before the HR department said that: There needs to be a "qualifying event" http://www.dmhc.ca.gov/library/faq/coverage/cal-cobra.asp#small to be able to drop coverage. However, qualifying event refers to GETTING or enrolling for coverage, NOT taking coverage off. The Blue Cross Manual says "Employees may be deleted from the plan due to termination of employment, ineligibility for coverage under the plan or when the employee does not wish to continue coverage regardless of his/her employment status and/or eligibility." Ask the Employer or Insurance Company to cite the law or their manual. It appears they are confused between getting coverage midyear and taking coverage off. CA Insurance Code 10700 et etc. applies to GETTING coverage - not taking it off at the employees request http://www.leginfo.ca.gov/cgi-bin/displaycode?section=ins&group=10001-11000&file=10700-10701 For more information see www.SteveShorr.com/ic.10700.htm

Yes, in certain situations. For example, 1) If you are no longer considered an "Eligible Employee" - (ie. you no longer work enough hours to be considered full-time); 2) If your employer discontinues the plan for all employee's. Note: Any involuntary loss of coverage may be a COBRA or HIPAA event.
