Yes it can. Apple will charge you 199.00 if you don't have their insurance. Found a place quickly on-line that would do the same job for $80.00 but that of course probably voids any warranty you have on the phone.

You can only get an upgrade if your contract is due to be renewed. If your iPhone is broken then you can take it to the genius bar at an Apple store. They can give you a replacement but you will have to pay for it.
