There is no legal prohibition to getting a loan after having three Chapter 13's dismissed, though each one of those Chapter 13's had an impact on your credit rating and may influence a lender negatively in terms of both what they did to your credit score and also just the fact that three times you tried and failed. You can always apply with a mortgage lender and see what happens. Each application may have a small affect on your credit rating too, so you can pick a couple of mortgage companies you like and give it a whirl. Please note that nothing in this posting or in any other posting constitutes legal advice; this is simply my understanding of the facts and law, which I do not warrant, and I am not suggesting any course of action or inaction to any person. Speak to a lawyer for specific advice. If you have any questions, please refer to a lawyer in your jurisdiction. Thanks!

If you are dismissed from a chapter 13 and have your mortgage reinstated can you refinance your home?

You can refi a day out discharging of bankruptcy depending on the situation.

If a chapter 13 bankruptcy was voluntarily dismissed not discharged can it be removed from your credit file?

You can't get it removed. It is a public record. If you file a bankruptcy and get it voluntarily dismissed the next day, it will still be on your credit report. Also, by the way, not paying into a Chapter 13 plan is not a voluntary dismissal. The Trustee moved to have the bankruptcy dismissed. - The easier approach would have been to actually voluntarily have it dismissed. Regarding Nate's posting, I agree that non-payment of a Chapter 13 normally results in the trustee moving to dismiss your case, which is an involuntary dismissal. I have no idea if whether a Chapter 13 is voluntarily or involuntarily dismissed affects your credit rating differently (probably not, credit reporting agencies barely seem to recognize the difference between Chapter 7's and Chapter 13's, much less the way in which any particular case is dismissed), but there can be a big difference to the debtor whether a case is involuntarily or voluntarily dismissed if a creditor has moved to get property back. Once a creditor asks the court for permission to get back some property (such as a car or home), which they do by filing a Motion for Relief from Stay, then if you voluntarily dismiss your case you are barred from re-filing a new Chapter 13 for 180 days. This 180 days may be enough time for the creditor to foreclose/repo and sell the property. Once a creditor moves to repo/foreclose in a Chapter 13, many people prefer to be involuntarily dismissed so they can re-file a new Chapter 13 immediately and get protection again before the creditor sells the collateral. Please keep in mind this is not legal advice but simply a statement of what many people do in that situation from my perspective. So, while Nate (in the posting above) said it is easier to voluntarily dismiss, that does not mean it is always better to voluntarily dismiss, depending on the circumstances.

If you have two chapter 7 bankruptcies on your credit report is there any way to show only one?

No. If you filed 2 bkrs, then they will both show up under public records. Example: If you home was foreclosed on, you stopped it and it was foreclosed on again - 2 foreclosures would also show up.

Which bankruptcy is for a home?

You can file either Chapter 7 or Chapter 13 as a homeowner. If you are trying to save the home from foreclosure, then Chapter 13 would be the proper chapter.

Can you convert from a Chapter13 to a Chapter7 and keep your house if your payments are current?

If your home is "reaffirmed" within the chapter 13 and chapter 7. which is basically, you paying the lender within the bankrupcty transaction to contract with you in keeping your home and not losing it. please note: each time you "reaffirm" you are paying each transaction, i.e. chapter 13 (1x) converting to chapter 7 (2x). you can only convert any case ONLY one time. i.e. if your Lawyer errors and lets say begins as a chapter 7 then converts it to a 13, and it should have been a 7 to begin with, then you must request it to be "dismissed" and refile a NEW case. If that happens, get an entire NEW Attorney so this does not happen again. good luck.
