Following Chief Justice Roberts' "unilateral" decision to exponentially expand the federal government's taxing powers this past week, I was hopeful there was precedent to remove him from his position as Chief. It appears there isn't one.

But, no matter. The Chief's position is largely symbolic and administrative in nature. His vote counts no more or less than that of any other Justice.

If we don't like what he did, our remedies are: a) to not reelect President Obama, and b) to hold President Romney's feet to the fire if and when he makes nominations to the Court. It is our own fault we gave President Bush and the Senators we rely on a "pass" on the nomination of Justice Roberts, if for no other reason than they didn't vet him adequately or we weren't paying close enough attention.

In other words, were there another bona fide conservative jurist on the Court, it wouldn't have mattered how Justice Roberts, Chief or not, voted. The lesson to be learned here is we must be more vigilant of our President's court appointments and follow the Senate's confirmation process more closely, and not only for the Supreme Court.

Answer

In Roberts' considered opinion, the health law is a tax, which is within the government's purview. His vote made the day; it was not a unilateral decision on his part.

To me, we vote for people we think will take information and write and vote for laws that make sense for us all. In some respects, it is like putting a player on the field--he has to go left or right depending on where the ball is. In all cases, we do not have access to the same level of information that the people on the ground doing the job have. It is an impossible situation to have expectations that it is otherwise. So, a pledge in advance of the decision does no good; stonewalling on a single position fails to solve an issue; firing someone who kicked the ball in the wrong direction is not the way to go. Most of us learn from failure and the next idea could be genius.
