No. Only the court can grant a guardianship. You need to petition the court for the change in guardianship. You cannot assign your own temporary guardianship to someone else.

No but a parent can file the necessary documents with a court and the court can allow the appointment of a temporary guardianship. Contact the Clerk of the Court in your county and inquire about obtaining the necessary forms you will need to file. A good attorney will be happy to tell you about the procedure. Legal Aid may also be able to offer you assistance.

With a written agreement yes. However, that adoptive parent could actually lose any chance at custody to the child at a later point because they may be deemed unable to take care of the child (for relinquishing custody). It varies situation to situation.

Can a custodial parent sign over temporary custody if the non custodial parent is in prison?

No. Only the court can enter an order of temporary custody. With the non-custodial parent incarcerated and with the consent of the custodial parent the court would likely approve a temporary guardianship that is in the best interest of the child.

Can a non custodial parent get emergency custody from a custodial parent if the custodial parent is giving child adhd medication against physician orders?

The noncustodial parent would have to call the state's child abuse hotline and report this to them, and then await their instructions on how to gain custody of the child if they should be taken away from the parent.

The custodial parent leaves the child for long periods of time with the non custodial parent making only very short infrequent visits. What can the non-custodial parent do?

The non-custodial parent should file for a modification of the custody order to become the custodial parent. If they have physical custody most of the time they also need to have legal authority over the child. They should visit the family court with jurisdiction over the case and ask to speak to an advocate. Or, they should consult with an attorney. The non-custodial parent should file for a modification of the custody order to become the custodial parent. Can a relative get custody of a child over a non-custodial parent if the child is removed from the custodial parent's home?

Yes, but keep in mind that the law is predisposed to award custody to one or both of the parents. If you have serious concerns about custody going to the NCP, I suggest you discuss this with a lawyer.

From what I read both parents must sign temporary custody for it to be valid. If parent with custody signs over temporary custody to a non relative can noncustodial parent step in and take child?

Not without a a first right of refusal in the current custody orders, or custody modification

Can a custodial parent in a joint legal custody arrangement gain primary physical custody of the child if the noncustodial parent violates visitation agreement by taking the child over several days?

No

Does a non custodial parent have any rights regarding their child?

No. Ordinary citizens do not have the power or authority to revoke parental rights. That is the province of the court. You have to petition a court, present your evidence and let the judge decide.

What do you about support when you are the non-custodial parent and the custodial parent wants to hand over the child to you?

They can't simply "give the child to you." You need to return to the court and have the custody order modified so you'll have legal custody. It will go easier if the current custodial parent consents to the modification. At that time the current support order should be terminated and you can request child support if you wish.

What is the difference in custodial parent and non custodial parent?

A custodial parent has legal authority over a child. The custodial parent has the right to make any decision that affects the child such as school, medical treatment, daycare, religious training, sports, etc. A non custodial parent does not have the legal authority to make any decisions, choices or sign any legal documents that affect the child although generally, a visitation schedule can be ordered by the court and the custodial parent must obey that order. Joint Custody gives both parents equal authority to make decisions that affect the child and both must consent to any decisions regarding school, medical treatment, religious training, sports, etc. With joint custody one parent may be awarded physical custody and as such will be awarded child support.

Do you have to have both parents' consent for an underage marriage in Pennsylvania and can one parent sign if they don't have custody over that child?

If you are under the age of 18, then the consent of the CUSTODIAL parent or Guardian is necessary. So, if this parent does not have custody, then they cannot sign for you to get married.
