Can they take a car or motor home that is in two names in Missouri if the credit card debt is only in one name? |

Answer
That depends on how the vehicles are titled and when they were purchased. If both names are on the title without any stipulations and they were purchased during the marriage, they are not liable for attachment or sale by creditors of only one debtor. MO. recognizes Tenancy By The Entirety when it pertains to married couples. This law includes real property, bank accounts and some pensions, annuitites, etc. The trustee may still challenge the right to exempt the vehicles, but the courts have always upheld the TBE statutes.
