No, as drugs (referred in this case as illegal narcotics and not prescription) are still illegal most of the world over, a failed drug test is not covered by workman's compensation as it shows that the person is/was participating and/or around illegal substances, which again is against most local and federal law.

Actually it is not necessarily to take drug test requested by your employer

But, its better for you to take drug test to proved to your boss that you are not drug user and to proved that you are responsible employer in his company.

You could fight it, but you'll probably lose. Since you've failed the blood test then you zapped yourself! Drugs and work just don't mix. Workmen's Comp is only there when you've had a genuine accident. If you were doing drugs (even Marijuana) WCB has a good case NOT to pay you. If you were on a cold medication and you failed a blood test then you might have had a chance. Marcy
