I have had the investigation thing happen to me like 10 times probably, and not once have I been banned for at least an hour. It is safe to do that.

I was put under investigation but the way its worded it seems that they are investigating not your account but the trouble saving your xp.Read it carefully.It says "Error saving xp your account has been recorded to investigate this issue the way it is worded they are not investigated you.This is not 100%.this is just a theory.

Apparently, you can get banned. There's a thread on the Battleon forums about people getting banned. They even shut down your character page.
