no. you can't evict her because you are still married. if you get a legal separation from a lawyer then you may have a right but not at this point.the law reads that a husband and wife are responsible for each other . regardless if she works or not. if you go to a lawyer and want her out of the home, more than likely they won't do it because of her not working. you may also have a order put on you to pay alimony for her to move out and give her transportation in order to get on her feet and get a job. so you can do one or two things, move out yourself and get a apartment and she will have to rough it out. if she goes to a lawyer she won't have any money for a lawyer to represent her.i know, i use to be a paralegal for a law firm. she can't get legal services because they have a long waiting list and its usually for unwed mothers . as long as you are there, she can eat the groceries, use the phone, sleep there and if the cops get called out , they will say its a "civil matter". they won't take either of you to jail unless you two are disturbing the peace or domestic violence. she can also get credit cards in both of your names since you are married. if she is on your account with the bank, she can order more checks without you knowing, get another ATM card, etc. if you have direct deposit from work you can change that and get your money into another bank. change all your credit cards , keep the same company but just change to another card number. if she has a car she will get a job. if you don't come around long enough she will have to do something for herself. if everything is in your name, power, phone gas, then turn it off. place a red flag on the utility companies that noone is to turn on anything uless its done by you and in person with your id for proof. that way she can't go around you and have the stuff turned back on. these days they don't care as long as they have a address and a deposit. unless you specify not to because that is your home. they won't turn a utility on if the person don't have money.
