Can you get a divorce if your spouse's whereabouts are unknown? |
Answer
"If your spouse is missing, you'll have to do something called "service by publication". You can do so by running an ad in your local area newspaper. That ad becomes your "proof of service" and proof to the court that you tried to find your spouse. There will be a 30 day waiting period during which your spouse is supposed to respond. If your spouse doesn't, you will be granted the divorce based on default. If your spouse does respond, how the divorce process continues will depend on whether your spouse agrees or contests the case at that point."

I'm sure you can. Go to the court house and file divorce papers and fill out everything that you can. They will tell you what you have to do.

Here are a couple of sites you can check for advice.

and I found this tidbit (posted on a messageboard @ one of the above sites) about divorcing a missing husband:
"...if he can't be served with the paperwork, then you'll likely have to publish it in the local newspaper. If no response from that, the divorce will still be granted, it just takes time and money."
Good Luck!

A friend of mine had the same problem. in most places they will post an ad in the paper of the last known place your spouse lived. if they do not respond within 30 days, you can have the divorce finilized without them. good luck, i hope everything works out for you.

Hi :)
In the UK you can apply for a divorce without knowing the whereabouts of your spouse but it is well worth checking to see if they have actually divorced you first :) When you apply via a County Court you can check this out :)
UK: If you wish to find their residential address it is well worth giving

a try, you can search the electoral roll. There is a charge for this in credits but you can also earn free credits which is explained to you on the site :)
Please be *absolutely* sure you hve the right person before you start having papers served on some poor unsuspecting soul :)
Answer
All you have to do is file a contested divorce. Even if you can find out where they are and can't get them to agree to a divorce you can still get it. It takes longer and sometimes cost more than if both people were involved but it can still work. It usually takes around 6 months to get it finalized where a non contested divorce can be final in 3.
