In Canada, you can have a passport even if you have a criminal record. However, some countries might prevent you from entering their territory because of that criminal record.

You can also get one in U.S.A. as long as you are not specifically barred by the court from having one. I.E. if you owe back child support. A passport is nothing more than an identification document and doesnt guarantee admission in to a foreign country

My name is Kyle and I am a client services specialist that has experience in assisting individuals with criminal records who would like to travel to the United States. Upon reviewing the posts on this blog, I would like to clarify a few myths regarding cross boarder travel. Many Canadians believe that a conviction that happened during their adolescents or early adulthood will not affect their ability to travel into the United States, they simply believe that as long as they have a valid passport they will be granted entry. Unfortunately, this is far from the truth. As previously stated boarder patrol officials have access to CPIC which will allow them to pull up your criminal record when checking your passport. Moreover, if you are denied entry into the United States you will be required to obtain a US Entry Waiver which can become a very expensive document that may only be valid for one year.

There are many Pardon Services in Canada that can assist those in need. A pardon acknowledges that you have repaid your debt to society and that you are entitled to a fresh start (which, of course includes travel to the United States). Don't cut yourself or your loved ones short from experiencing the wonderful sights and places the United States has to offer such as Disney Land or Las Vegas! Give a new meaning to both life and the term I Beg Your "Pardon!"

In most countries a criminal record does not prevent you from obtaining a passport. (Obviously, people with convictions for passing on defence secrets and the like are in a different category. Also, you can't get a passport in order to flee the course of justice or to jump bail - but this is different from what you mention).

You may apply for, and receive, a US passport. However when you apply for a visa to travel to some countries, they have the option of refusing you entrance to their country.
