If the other person has EVER had a cold sore then you are susceptible to getting them. Regardless if they have an outbreak or not the herpes virus is still active. If you have a cut in your mouth or on your lips or if your lips are dry you are more likely to get them.

A cold sore may be caused by type 1 or type 2 herpes simplex virus (HSV). The virus is contagious while the herpes sores (cold sores) are present, and during the time just before the sores show up. Skin to skin contact can transmit the virus, so if someone with a cold sore kisses your lips, you can get the cold sore virus, and if they kiss you somewhere else, you may get herpes sores in that other location.
