In Texas, you can only get your deposit back if your application is rejected and/or you have 3 days from the date of application to chane your mind. After that, you are not eligible to et your "application deposit" back.

You should be able to get your deposit back. You would only get the first-month's-rent back if the landlord manages to rent it to someone else for that month. It doesn't matter that you never signed anything - you created a contract when you gave him the rent.

Normally a lease is not signed until the deposit has been paid. So if you do sign the lease when you have not moved in or paid the deposit, you have the advantage and are probably not obliged to continue the tenancy.
