In granting a divorce in California, judges can not use adultery or infidelity as a reason. However, they can consider the financial impact a partner who cheats on his or her spouse may have. In some cases, a judge may also consider if the adultery had an effect on the children of the marriage as well.

adultery = one or both persoms are married to other people.

You don't go to jail for adultery. It's not a criminal offense. You could get beat up by a spouse or sued if you're rich.

Answer:California, no. It used to be, and in 20+ states it still is, with fines/jail time of $500/30 days in jail up to $10,000/3.5 years in jail. The idea is that since marriage is a contract, adultery is breach of that contract.

Bigamy is a crime but it is rarely prosecuted these days. Bigamy is "formally entering into a marriage while the previous one is un-dissolved". So that if one spouse remains married, and tries to enter into a second marriage, this is considered bigamous and the second marriage is declared void and grounds for an annulment. Therefore, one who knowingly enters into a bigamous marriage is guilty of the crime of bigamy. In practice however, bigamy is seldom prosecuted unless it is part of a fraudulent scheme to get another's property or to commit some other felony.
