Yes, assuming that the couple are not married. An unmarried mother has sole custodial rights until the biological father establishes paternity and is awarded custodial and/or visitation rights by the court.

Yes, you decide who is or isn't in the delivery room. His legal rights to the child do not extend to the delivery room. However, once the baby is born, he has as much right to it as you do. You cannot keep him from seeing his baby unless you have a court order and even then, you need a good reason to deny someone their rights.
