It can be filed under the homeowners insurance as long as the person injury was not injuries in their own home. Homeowners insurance does not cover medical injuries for someone who lives in the house where the injury occurs.

Accidental injuries are best covered under your Health Insurance Policy.

Home owners insurance is designed to cover a residence. It's property lines coverage. The home insurance policy typically provides very little coverage if any at all, for household injuries that fit the terms of the policy, where as your medical insurance will have no limit on coverage and it does not matter where the injury occurred.

In order to claim against the homeowner you will need to be able to prove that it was the homeowners fault you were injured. Just being the owner of the home does not make them liable for your injury,

Your medical insurance does not care who's fault the injury was, nor do they care how or where it happened or who's fault it might have been.
