If one of your parents is the biological parents of you and your half sister then no you cannot get married and it would also be a genetic factor against you if you should want children. The only way a half brother and half sister could get married is if the father (or mother) had children from his/her first marriage and his/her second wife/husband had children from another father/mother from a previous marriage.

Take note that this was not what the poster asked. They are wondering if the fact can be superseded due to the lack of available data to show they are, and to that the answer is yes. The fact is there are likely many such cases today, with the growing number of women who have no idea who their father of their children are, especially as regards sperm bank children. A year ago I came across a push to abolish the incest laws for consenting adults, due to growing reproductive and DNA technology. Of interest, New Jersey has no incest laws regarding adults.
