Can a Medal of Honor be sold?

A Medal of Honor can never be sold. It is Illegal to sell, own, wear a medal that was not awarded to you while in the service to our country.

"In General. - Whoever knowingly wears, manufactures, or sells any decoration or medal authorized by Congress for the armed forces of the United States, or any of the service medals or badges awarded to the members of such forces, or the ribbon, button, or rosette of any such badge, decoration or medal, or any colorable imitation thereof, except when authorized under regulations made pursuant to law, shall be fined under this title (18 United State Code) or imprisoned not more than six months or both. "

The sale of Medals of Honor is regulated by federal law Title 18, United States Code, Section 704. This law prohibits the buying, selling, trading, importing, exporting, or bartering for anything of value for a Medal of Honor. The law makes no mention of inheriting a MOH, or GIFTING one, legally you can only obtain one if you are given or inherit one.

There is no current law that prohibits owning or posessing any military medals,Once medals are presented they are considered personal property of the recipient and can in fact be given to anyone they chose to give them to.

The stolen valor act of 2005 makes it illegal for unauthorized persons to wear, buy, sell, barter, trade or manufacture "any decoration or medal authorized by Congress for the armed forces of the United States, or any of the service medals or badges awarded to the members of such forces." However even under this law it is not illegal to own or possess military medals or badges.Nor is it illegal under this law for a person to be given medals or badges under the term of gift or inheritence...

Under current laws it is also legal to buy or sell the certificate that was issued with the MOH,The sale of the MOH presentation box is also legal under the law.In recent years after the laws were passed the sale of an original WW2 MOH presentation box and certificate sold for over $28,000 at auction (the unnamed seller included the actual Medal of Honor itself as a GIFT of appreciation to the buyer of the box and certificate)...

A simple loophole that has been left unchanged..

Absolutely not. If even attempted to be sold, a felony has been committed and then the FBI comes and removes it. The hell with search warrants. The seller would face a possible 20 years in prison and/or a possible fine of $2 million US Dollars.
