No it is not legal unless you get permission and give proper credit in your script.If you notice, most works (movies, books, comics, etc) will all have a tagline appearing in the credits to the effect "XXX character appears courtesy of XYZ company" or "XXX character is a trademarked property of XYZ company and appears with permission".

You would really need to have an agent representing you and your script. The script would be sent to a production company that might then purchase the script. If you are interested in writing on one of HBO's series - you need to get hired by the show. That involves having some samples and usually knowing someone in the industry. HBO itself does not read scripts.
