Can your husband's ex-wife collect on his Social Security? |
[Edit] |
Answer
I know in South Carolina they can. The ex-wife, even if remarried, can choose which one made the most money and draw SSI off of it. However, it does not affect the amount the ex-husband or the second wife will get. In the eyes of the law the "first" family comes before all other.
Social Security benefits are federally controlled.
Ex-spouses may be entitled to a portion of SS pensions depending upon how long the marriage lasted and the SS benefit status of the ex-spouse.
