How much older? That makes a big difference. If the age difference is not very great (less than two years) and if you were seventeen when you got pregnant then the likelyhood that the court will see fit to send him to jail is slim. If he is more than two years older, you were sixteen when you got pregnant or there is reason to believe that he drugged you/got you drunk/used some devious means to get you pregnant then maybe they will. Consensual underage sex is not a violent crime or even a more than a misdemenor depending on the circumstances. If you can stick it out and are concerned for his freedom you make want to bargain with your parents and not see him (or whatever) until you are eighteen or talk to someone from LegalAid, they might be able to help you out.
