It depends on how the immigrant entered the U.S. If they entered legally, then no they do not have to leave the country. However, if they entered ilegally, they would have to their country of origin. What will happen here: Since you filed an i-485, I imagine that you have a lawyer (stupid not to have one). After a couple of packets, you will receive a visa, and an appointment with the Immigration in your country. You will then have to go to your country, and report to them. You wife/husband will need to show how it would cause them hardship for you not to be here (think pshycologist papers, schooling, children, etc.). If you have not had any major problems here in the US, They will then grant you a visa to get back, and your residency. Hope this helps. This is how I am getting it done. I know that it's a burden to have to go back, but think of it this way... chance to meet the in-laws. LOL
well the question of the daay would be are they married????
yes, illegal immigrant can be deported even if he/she has children who are US citizens. moreover harbouring an illegal immigrant is a serious offence. please refer to US department of homeland security website www.dhs.gov
It is legal in the United States for an illegal immigrant to marry a US citizen. Once the marriage is legal, the illegal immigrant becomes a legal immigrant and can stay in the US for the course of the marriage.
Marrying a US citizen does not automatically make the other person a citizen. Spouses of US citizens can and do get deported everyday. Send him back home and apply for him while he is not in the U.S.
its possible, depends on the ff 1.if you are married to the eu citizen?! then you can 2. if youre not married you'll be deported, your child at the age of 18 has the right to choose which country he/she wants to settle in
You can be removed from any country that has a valid reason for the deportation. Esp if they have a warrant against them in a country just waiting to hear from them and NZ does not want them there.
It's not illegal.
No he cannot
If you are married, you can apply for divorce.
no not unless they where married to a USA partner.
Of course! Being married does not affect one's legal status, even a legal alien can be deported for criminal activity.
the US citizen shouldn't
