There are two ways that a person can receive Disability benefits: from Social Security and/or from an employer or individual Disability policy.

If your employer does not provide Disability insurance coverage and you do not have your own individual Disability coverage, you will not be able to receive disability benefits, unless you live in a state that has a state-sponsored plan.

In order to receive benefits from a Disability policy, you must actually own one or have coverage through your employer. Additionally you must satisfy the requirements of the contract in order to receive benefits.

Social Security benefits only pay benefits on disabilities that are expected to last longer than 1 year or end in death, so you would not qualify for Social Security benefits.

Can you collect short term disability for surgery in Indiana?

Short-term disability benefits may be payable under a private insurance policy procured by you or by your employer. The policy will provide a definition of "disability" that has to be met in order to trigger benefits. Depending upon the definition, you may have to be rendered unable to perform the duties of your regular occupation at the time of the disability, or disabled from performing any duties of any occupation for which you are otherwise suited by education and experience. The policy may also prescribe a waiting period before benefits are payable, and will provide a maximum duration for benefits. Therefore, the nature of the surgery and its effects upon you will determine whether short term disability benefits will be payable.

In theory, an employer can not terminate an employee out on disability, assuming you provided sufficient documentation. If you think you've been wrongly terminated, then I'd contact the EEOC. They can provide you with more info and point you in the right direction.

How do you collect disability when your work place doesn't provide it and you are out of work for 4 to 12 weeks due to Maternity leave?

AnswerWhat about State Disability? State disability applies only to people who work in the state. Currently there are five states that mandate coverage: CA, HI, NJ, NY, and RI. If you live in one of these states you will likely get some benefit. If you live in one of the 45 states that do not, you must apply for short term disability insurance preconception, and your maternity leave will be a covered benefit. Individual plans sold via work site marketing are the only policies that provide maternity leave coverage. It's easy to ask your employer for the option.Your employer needs only to deduction the insurance premium from your pay, and forward your money to the insurance carrier once a month.

Can you collect short term disability from two different employers at the same time?

Yes. For more information you might want to check out the links on the right. If you injury was work related in the first place, I'm not sure why didn't file a worker's compensation claim. If you do file a worker's comp claim, the disability insurance company will likely want to collect much of the money you receive because typically worker's comp is an offset or an exclusion from disability plans.

Not unless it is because of a disability. If you are currently pregnant, it is currently not a time to buy. It's easy to get your employer to offer this benefit. All they need to do is deduct the premium from your pay, and forward your money to the insurance carrier once a month. There are two law that provide job security during your leave for disability: the FMLA provides twelve weeks of unpaid leave for your disability. NJ has a separate law, but it provides leave for you to care for a sick family member - not your own disability. Your employer does not have to hold your job open if FMLA does not apply, or if your leave extends beyond 12 weeks.

Does ga offer short term disability?

I think it depends on the company and their Short Term Disability plan. The company I work for does have maternity in there short term disability thankfully. Ask your Human Resources Director or your manager. They should be able to pull up the company's disability plan. The state of Georgia does not have a mandatory short term disability program. It leaves the choice up to the employer. Short term disability programs sold via workplace marketing will provide a maternity leave benefit, provided you enroll preconception. If your employer does not offer short term disability, it's easy to ask them to do so. Your employer simply needs to agree to deduct the premium from your pay, and forward the premium collected to the insurance carrier once a month. There is no direct cost to your employer, and no obligation to fund any premium not deducted from your pay.
