Did Hitler gain control over the country legally or not?

Completely legal. The Nazis won the election of 1933 and Hitler was appointed chancellor (prime minister) by President Hindenburg. After that Hitler got the Reichstag (parliament) to vote to give complete power to him and the Nazi Party. Michael Montagne

Answer

Hitler came to office legally. It's debatable whether the degree of control he exercised over Germany was legal. For example, he made several constitutional changes (such as abolishing the federal structure of Germany) by decree. It's widely held that these measures were illegal.
