Illegal Immigrants are broadly disqualified from collecting benefits from government programs, according to U.S. Code, with only limited exceptions. Those exceptions are:

  • Emergency medical care (which includes emergency labor and delivery)
  • Emergency disaster relief that is provided for the short term and is not a cash payment
  • Limited immunizations and testing, and treatment of symptoms of communicable diseases
  • Certain community programs, such as soup kitchens or crisis counseling, as specified by the Attorney General
  • Limited housing or community development assistance to those already receiving it in 1996

These are the only circumstances under which illegal immigrants can lawfully receive government assistance. Notably absent from this list is any type of Social Security benefits. To repeat: Illegal immigrants cannot legally receive Social Security benefits, and Congress isn't about to vote on legislation that would change that.

Added March 3, 2011 - Actually, the information above is not totally accurate. As per personal involvement with California WIC programs (a Federally assisted supplemental nutrition and aide program for Women, Infants and Children), I can attest that this government agency will accept a Matrícula Consular de Alta Seguridad (MCAS) as valid identification for eligibility into the program.

For those who are unaware of the Matricula Conselar, it is an identification card produced by the Mexican government that extends consulate privileges to Mexican nationalists residing outside of Mexico.

Accepting this document as valid identification into the program, allows tax- and social security-funded resources to be given to "illegal" aliens who have never paid (and may never pay) into the money-generating system of taxes and social security. Given, this is a "work around" the established norm, having worked with several WIC agencies, I have personally witnessed considerable resources being extended to non-Americans thru the WIC programs.

Added March 27, 2011-Actually, The Matrícula Consular de Alta Seguridadhas been issued by the Mexican government since 1871 and only denotes that a Mexican National is living in a foreign country. It has no bearing on the Immigration status of that individual.

This bill specifically states that no immigrant will be allowed Social Security benefits unless they become a citizen first, thereby paying into the Social Security system. Also, many "illegal" aliens are also paying federal taxes in hopes of increasing their chances of gaining citizenship.

Added March 29, 2011 - While an accurate reiteration of the Matricula Consular as taken from Wikipeida's page (http://en.wikipedia.org/wiki/Matr%C3%ADcula_Consular), if you read further into the page, you will see that indeed, "Several US states, municipalities, and businesses have been accepting the Matricula Consular as an official form of identification." But it's not really about what the paperwork reads, is it? While the Bill may actually specify that immigrants are not allowed Social Security benefits, the fact that they ARE receiving such benefits should serve to provoke our interests as to why and what do we need to do in order to stop it.

Having worked with several WIC facilities and other social service orientated government agencies, I can only account for what I have personally witnessed. What I've witnessed within each of these agencies is a sampling of such institutions that do allow for our Social Security benefits to be handed to individuals living in the US illegally (despite what political paperwork says). Simply go onto their websites or give your local WIC agency a call and inquire about it. These government-funded institutions are allowing such blatant access to the benefits we've paid for, with as little as a Mexican-issued identification card.

Did anyone work the California polls last year? If so, do you remember being told in the official training that if someone presents a Matricula Consular as a form of ID, that we were instructed to provide them with a ballot (this too can be validated by going onto the CA Voters Registrar's website)? Our precinct had eight such ballots go into our voting system. I know because I was responsible for having to process them. And if the precinct I worked had eight, how many more actually infiltrated the system? Ours isn't even a readily accepted Hispanic community. While this is not an example of our Social Security benefits being handed over to illegal aliens (yet), it does show very little regard of the US Government maintaining any kind of sanctity for the American people and their rights. And while paperwork may say one thing, it's the actions of our Government that really requires our attention. Be forewarned, because the greatest terrorist threat to America and its continued democracy, lies within its own government.

Some people claim the then senator voted in favor of allowing illegal aliens to collect the Social Security benefits that other, legal workers worked hard to put into the system.

The controversy stems from intentional misrepresentation of several key facts.

1. Where Illegal workers pay into Social Security system using fake or "stolen" Social Security numbers. Which would contribute those benefits that of the original and legal holder of that number or identity. Transferring any value out of it to a person other then the proper holder would be fraud even if that person had paid into it in furtherance of identity fraud. Any later claims to that resource would still be identity theft and would tie that person in a act of felony fraud.

2. Illegal workers are granted legal immigration status under CIRA. Once with legal status, they can get citizenship and apply to retroactively receive credit for contributions made before becoming legal. However, where contributions were made under false social security numbers, they would not be getting benefits from lifetime contributions made by legal owners (and the legal heirs or beneficiaries) of that social security number. No provisions were made to reclaim ill-gotten funds made while those persons where in an illegal status. The SSA (Social Security Administration) routinely cleans out contributions made by fraud, proceeds go into the general fund not some imaginary fund for illegal aliens.

3. Now legal workers apply to retroactively receive credit for the payments that they contributed to the Social Security system before becoming legal. Not all Illegal workers used false Identities, some who have worked legally in the past or while in pending status, these are the ones who will get such credits.

4. No provision was ever made in this act to facilitate identity theft.
