But returning a new car or used cars for practical reasons is a totally different issue and than just returning a car. If the car has any problems, defects, or is not performing correctly then it can be returned regardless of the purchase contract. Most dealers or brands don't want to be drug through the mud. Remember, it is the manufacturer's obligation to make sure the car is delivering optimal performance to the customer. This is usually where a disconnect occurs between the dealer and manufacturer. The manufacturer has an obligation to the dealer to deliver and stand behind products that are not functioning properly. Unfortunately, lemon laws do not always take care of this problem, and the consumer is stuck with the car. In the sales process, misrepresentations of material fact may be made at times, just to persuade the consumer. Proceed with caution, the US legal system usually does not deliver the justice many deserve. This happens most when there is an imbalance of power between the stakeholders.
