- I, personally, have fallen victim to such a case. She called the police and said I threatened her and the children. Actually I did tell her that if she didnt leave me alone she would be sleeping outside that night...however, I did NOT threaten her with violence. The police did not arrest me - I told them the truth, in detail, of the verbal exchange.
- Two days later she file a restraining order against me (While we were still living together).
- I packed up my cloths and my PC and moved to an apartment 15 miles away. No furniture, no bed, no food.
- Almost exactly 1 year later (4 days short of a year) she filed another restraining order ...OMG... I lived 15 miles away, drove 45 minutes to work in the opposite direction, worked 7 days a week/12 hour days.
- I let this go (AGAIN!!) after I was told that there wasnt much I could do. although I had a police report stating that my truck and my girlfriends car were both vandalized the same night that she drove the 15 miles to stand in the parking lot and scream obscenities at my apartment (neighbors witnessed this)...but alas...no one saw her vandalize the vehicles.
- 3 years later, she files CHILD ABUSE/NEGLECT charges against me, stating that this happened while my children were staying with me for the summer. At, the time, I lived 700 miles away. She supported these charges with a verbal testimonial from her mother (who had not seen me in 3 years), and a written testimonial from her sister (who had not seen me in 5 years).
- Now I was fighting mad..I went to court to object to these false allegations...my two children were brought in to testify and were questioned privately by the presiding Judge. Apparently, they both said that their mother had been 'rehearsing' woith them what they were supposed to say in the courtroom. Her so-called witnesses didnt show up.
- Court Results: Charges dropped - (more like thrown out) - the judge seems disturbed with her and her lack of credibility. It was apparent that there was no evidence.
- The Conclusion: I now have, on my record, allegations of child abuse and/or neglect. I cant become a foster-parent, I cant adopt any children, and I cant get a job around children. Just the allegations are enough to ruin a persons life.
- Did she get punished for filing a 'FALSE' complaint? No, because they cant prove they she 'knowingly' filed a false complaint.
- Defense: There is none...unless you video tape and audio record every second of your life as it happens, and keep a complete archive in safe-deposit boxes at a bank.
