Depends entirely on the fee arrangement made between the client and the attorney. For the most part, yes, just because they lose the case does not mean they are working for free. Civil cases, particularly personal injury, are often done for a percentage of the win. But the client may still have to pay the court costs. In criminal cases, yes, they get paid win or lose.

Lawyers work on an hourly basis.

There are lawyers who work on percentage basis, standard/hourly rate and fixed rate. A personal injury lawyer who works on a percentage base will only get something when the case win, however, the costs still have to be paid by the client.

However, if the lawyer is on standard/fixed rate whether the case wins or not they have to be paid for their services.
