you can never know for sure. There has never been documented photographic evidence. Many obviously computer generated or faked pictures of mermaids exist, which minimizes their legend's credibility even more. But you can't be sure so the best thing to do is keep an open mind!

It is though that no such creature exists in the ocean today, but there are several animals that are existent from which the stories could have been born, the sea cow for example including the dugong and some manantee. The mermaid story is one of the oldest legends among seafaring folk and although even the most drunken sailor could not mistake the face of a cow for that of a beautiful women, it is still believed that these animals gave arise to the stories. When these creature come up for air they hold their heads above water and remain in an upright position for sometime. At a distance the head might easily be mistaken for that of a human, and this resemblance is heightened when a female appears holding their young with their flippers.
Another factor to consider is the lack of reports about mermen, as the sailors would have been far more interested in the fairer sex, and the romantic image of a mermaid would have been a welcomed one, real or not.
Another Point of View
Actually scientists have found what seems to be mermaid mummies in Fiji . So yes mermaids are real. People just dont see them . Only if you fish in the Fiji waters will you find mermaids OR mermaid mummies if you're lucky.
