That depends. Most skyscrapers have piles set directly into bedrock, in which case, no, it would not settle.... It is possible to build them on soil, but they would have some kind of raft foundation and a very strong structure holding everything in place. For settling to occur on the 39th floor I would imagine the foundation of the building would be severely damaged.

How old is the building? Because that's also a factor. I have seen cases of 50+ year old concrete slab floors to start to sag between column spans, but an entire apartment shouldn't slant.
