Many states would not accept a provision in a divorce agreement that absolved the non-custodial parent from child support obligations. Children are legally entitled to the support of both parents and a parent would not be allowed to give up their child's right to support. If the custodial parent doesn't need the money then it should go into a college fund for the child. You should consult with an attorney. If the relationship changes between the parents the non-custodial parent could find themselves being sued for back child support.
