It depends on what type of mining you will be engaging in and on what scale....In most states you need a permit to dredge for gold even as a small scale miner. If you wish to open a large scale gold mining operation there will be many local, state and federal licenses that you will need. If you are just going to poke around with a pan recreationally you will probably not need a license but i would call the local courthouse or Bureau of Land Management (BLM) office just to be certain.

A "license" to mine gold in not important. What you need is the right to mine it. You can't go onto private land and attempt to remove minerals. Only the person who holds the mineral rights to that land (and it may not even be the owner!) can do that. Additionally, you cannot remove materials from public land. At least not without a government-issued permit -- if they'll even issue you one.
