A Mother has every right to decide what is best for her child.
If that means that after a day spent with the non custodial parent or other parent, even if they have temp custody, didnt go as expected, or you feel for some reason that it is unsafe to send your child with them again, then the best thing to do is notify your local authorities as to why, and the courthouse, so it gets documented.
Restraining orders, while they don't do much to protect families, they do allow something to be on legal paper stating that the other person doesnt have the right to just show up and take the child. It is like a type of safety insurance. I have found that restraining orders, are usually just that. A piece of paper can't stop a perpetrator from assaulting you. But it does ensure legal authority in your best favor. So, YES, you can decide to not give your child over to the other parent. They CAN fight it in court, but if they are At Fault for something, they wont win. And write stuff down!! Keep a journal and log everything, phone calls, what time the call came, what was said, the date, any assaults, or arguements, any accidents or verbal altercations, especially if they are done around your kids. Hope that's helpful.
