First, there is a time limit for filing an appeal, and you need to take the time to properly prepare evidence for the argument. The late James Cook, the father of joint custody was a friend, and he recommended preparing at least three months of evidence. Have you also considered Bird Nest Custody? see links below

What happens when you are taken to court for joint custody?

The other parent has filed a petition for joint custody. They want to have the right to be included in decisions regarding the child and perhaps want equal physical custody also. There will be a hearing. If you presently have sole custody and object to the other parent being awarded joint custody then you should consult with a attorney who specializes in custody issues who can represent you in the action. The other parent has filed a petition for joint custody. If you have joint custody of a child can this child move in with you?

If you have joint custody, there is one parent that is the custodial parent. A child can move in with you if you are the custodial parent or you can file in court to change your status to the custodial parent. The child should want to live with you as well.

You have joint custody with your ten year old daughter father moved to Kansas you live in CA and want to move to OR and he doesn't allow it?

If you have Joint Legal Custody, then neither parent can physically change residences without the approval of the other. If, per the question, the daughter is living with the father, or the father has "primary" custody, then you can move wherever "you" want, at least in my perception.

If you haven't established custody and the father has moved out of state and is now asking for joint legal and physical custody can he win?

It will be very dificult for the father to have joint legal and physical custody on the gounds that he is not avalible. The courts want the two parents to live in the same area to co-parent. He could if he moved back.
