How can one change the sentence of a prisoner on death row? |
Answer
There are basically three ways to change the sentence. First is through a direct appeal, challenging things like the rulings on the evidence by the judge or jury instructions. Second, a collerteral attack may be made on constitutional grounds through a writ of habeas corpus. Finally, a person can apply for executive clemency with the state govenor for state crimes and with the President for federal crimes. The sentence may also be changed due to Supreme Court decision in other cases or be legislation but neither avenue would be within the control of the prisoner to initiate the process.
